Promises Broken: Elon Musk X Heads to Court Amidst Allegations of Staff Bonus Concealment

In a recent legal development, a federal judge has ruled that X, formerly known as Twitter, is obligated to face a lawsuit from staff members who have accused the company of reneging on promised bonuses. The judge’s decision, denying X’s motion to dismiss the case, signifies a potential legal challenge for the social media giant.

The allegations against X stem from the failure to fulfill commitments regarding annual bonuses after its acquisition by billionaire Elon Musk in October 2022. Despite assurances from executives both before and after the deal, a lawsuit filed in June 2023 by former senior director of compensation Mark Schobinger contends that X failed to distribute the promised bonuses.

The legal action seeks class action status, representing both former and current X employees who were deprived of their 2022 bonuses. The presiding federal judge, Vince Chhabria, deemed Schobinger’s case plausible and permitted it to proceed.

According to Chhabria’s ruling, “Twitter’s offer to pay him a bonus in return became a binding contract under California law.” Notably, X, which has streamlined its public relations efforts, did not provide a comment in response to CNN’s inquiry. In its motion to dismiss, X argued against the binding nature of an oral promise and proposed that the case be heard in Texas. However, the judge asserted that, in matters concerning the enforceability of a contract, California law is applicable.

The June complaint highlighted employee concerns about compensation and annual bonuses following Musk’s acquisition announcement in April. Leading up to the acquisition’s completion, X executives repeatedly assured employees that 2022 bonuses would be disbursed at 50% of the target. The complaint notes that these assurances continued even after Musk’s acquisition.

Despite these promises, the lawsuit alleges that X failed to fulfill its commitment to pay out the bonuses. Schobinger left the company in May, citing Twitter’s failure to uphold various promises made to employees, including the non-payment of assured bonuses. This legal development underscores the significance of contractual obligations and the potential legal consequences for companies that do not fulfill promised employee benefits.
